Carrollton police charge man after fatal accident

Carrollton police have charged a 46-year-old man with intoxication manslaughter.

Andrew Clarence Davis III of Lewisville has been moved to Dallas County Jail with bail set at $150,000, records show.

Cmdr. Doug Mitchell said Carrollton resident Miguel Herrera, 45, was on his way to work Saturday evening when Davis crashed into him in the southbound side of Interstate 35E, near the Bush Turnpike.

Dispatchers received calls about the accident at 7:39 p.m., police said.

Davis, driving a black Pontiac sedan, hit the rear of Herrera’s black Ford F-150, causing him to lose control of his truck, Mitchell said. Once the initial rear impact occurred, Herrera hit a metal guardrail before his truck bolted over the rail and struck the pole of a highway billboard, Mitchell said.

The Dallas County medical examiner was called to the scene and pronounced Herrera dead.

“Multiple witnesses on the scene said they saw the sedan driving erratically,” Mitchell said.

While Carrollton police and firefighters worked the investigation, southbound traffic on the interstate was narrowed to one lane. Officials said eastbound lanes of the Bush Turnpike were partially closed for nearly six hours while crews conducted the investigation.

Carrollton police obtained a warrant to collect a blood specimen from Davis, as well as search his car.

“No empty alcohol containers were located [inside the car],” Mitchell said.

According to the Texas Penal Code, intoxication manslaughter with a vehicle is a second-degree felony punishable by up to 20 years in jail and/or a fine not to exceed $10,000.
