Smith, 36, is facing a charge of driving while intoxicatedfrom a January arrest in Flower Mound.
Denton attorney Rick Hagen said Smith's case is pending and he and his client plan to dispute it.
"Matt has been a citizen of Argyle all his life," Hagen said. "He is a man of honor, and this case should in no way impact the decision a voter makes."
Mayor Greg Landrum, who is seeking re-election, said the act Smith is charged with is irresponsible.
"The generation he's from … he doesn't really get it, you just can't drink and drive," said Landrum, 54. "As far as I know he hasn't been convicted. He is innocent until proven guilty, but he is not the type of person I want to be mayor of Argyle."
Smith's other opponent, Dona Shroektke, 58, said, "I find it unconscionable that he would mislead the good people of Argyle into voting for him for mayor."
Smith said that he would like to have a public forum with all candidates invited, in an effort to clear up any questions or concerns about himself or his opponents.
"Rather than getting into a mudslinging war, I am all about a public forum and let the public decide from there," Smith said.
