Denton seeks change of venue in lawsuit from former DME employees

The city of Denton has asked a Dallas County judge to move back to Denton County a lawsuit filed by two former Denton Municipal Electric employees.  

In court documents, the city claimed Michael Grim and Jim Maynard were "venue shopping" their case when they filed their lawsuit in Dallas County on July 10. The two men were fired after the city opened an investigation into contracting irregularities at DME. The pair filed suit one day before their terminations, claiming the city violated open meetings laws and the Texas Whistleblower Act during the course of the investigation. 

The city's request for a change of venue was filed Friday and the city's answer to the original lawsuit was filed Monday. In addition to denying the allegations in the lawsuit, the city claimed that the Texas Whistleblower Act could not be used in a private action, according to court documents. 

No hearing has yet been scheduled in the case.
