Dallas District Judge Martin Hoffman recently denied the city's request to move a lawsuit filed by two former city employees to a Denton district court.
Mike Grim, the former executive manager for power legislation and regulatory affairs at Denton Municipal Electric, and Jim Maynard, DME's former energy project development manager, were fired this summer in the wake of a contract investigation. The pair filed a lawsuit against the city government, originally claiming that city leaders violated the Texas Open Meetings Act and the Texas Whistleblower Act during the course of the investigation.
Before an Oct. 2 hearing on the change of venue, the pair dropped their claim that the city violated the opening meetings act. Texas courts allow plaintiffs to choose a court, with some restrictions, in whistleblower claims.
As a result, the employees' case is expected to remain in the 68th District Court in Dallas.
Court records show the case is expected to be assigned to a mediator. A trial date has also been set for March 2018.
