Lewisville man jailed on murder charge

A Lewisville man arrested in connection with a shooting over the weekend was booked in the Denton County Jail on a murder charge Tuesday.

Humberto Martinez-Benitez, 56, was arraigned Monday morning in Lewisville by Judge Kristine Primrose where bail on a charge of murder was set at $500,000 before being transported and booked into Denton County Jail early Tuesday morning.

According to Denton County sheriff’s reports, Martinez-Benitez is on hold without bond for U.S. Immigration and Customs Enforcement.

Detainers are critical for Immigration and Customs Enforcement to be able to identify and ultimately remove criminal aliens who are currently in federal, state or local custody, officials said.

Lewisville police received 911 calls involving someone shot after 1 a.m. Sunday morning. Officers responded to the Village North Mobile Home Park in Lewisville shortly after and discovered Jacob Gutierrez, 26, dead in the front yard. Gutierrez was shot multiple times in the head and chest and died at 1:27 a.m., according to the Tarrant County Medical Examiner’s office. The death was ruled a homicide.

Family told officers the two were drinking beer in their driveway in the 1200 block of North Cowan Avenue when five gunshots were heard. A Gutierrez family member came outside in time to see Martinez-Benitez and his adult son speed through the trailer park exit in a blue Ford Expedition, police said.

Carrollton police were able to stop the vehicle for a traffic stop and detain the two until Lewisville detectives arrived.

“We talked with the adult son and he has since been released,” said Capt. Kevin Deaver. “We will not be charging him and believe he might not have even known what his dad did until later if he [Martinez-Benetiz] mentioned it in the drive.”

During the interview process, Martinez-Benetiz told police about an argument about the way Gutierrez spoke to Martinez’s daughter-in-law.

Martinez-Benitez and Gutierrez are members of the same family, police said.
