Former Balch Springs city manager files breach of contract lawsuit

Former Balch Springs City Manager Kandi Hubert has filed a lawsuit accusing the city of breach of contract and violations of the Texas Open Meetings Act.
The City Council fired Ms. Hubert on a 4-2 vote March 10, three months before the end of her contract.
Interim City Manager William McDonald, who is also the city’s economic director, referred a request for comment to City Attorney Monte Akers, who did not return calls.
In her lawsuit, filed April 29 in Dallas, Ms. Hubert alleges that under her employment contract the city owed her $85,947, including pay and benefits, if it fired her without cause. However, the lawsuit says, she was paid only $29,296.
Ms. Hubert’s attorney, David Fielding, said she also alleges that council members violated the Open Meetings Act by deciding before the March 10 meeting to fire her and who her successor would be.
“It was all done in advance, and it was an orchestrated firing,” Mr. Fielding said.
