Collin County grand jury charges man with murder in the death of unborn baby

A Collin County grand jury has indicted a 22-year-old McKinney man on murder charges after police said he caused the death of an unborn child by assaulting his pregnant girlfriend.

Brian Christopher Canaday was indicted earlier this week. He is schedule to appear in court Aug. 6.

According to police, the assault occurred in May. The woman survived, but the fetus she was carrying was stillborn. 

A four year-old state law allows grand juries the option of indicting on murder charges if it believes a person caused the death of an unborn child. 

The law is considered controversial by some supporters and opponents of abortion rights because it addresses the question of whether a fetus is a person.
