Blotter: Repo attempt results in 6 arrests

08:33 AM CDT on Tuesday, September 29, 2009

By Donna Fielder / Staff Writer

Denton County sheriff’s deputies arrested six men and impounded five tow trucks after determining they were trying to repossess a number of vehicles from a company without a court order Friday night.

According to a sheriff’s report, a woman called about 7:30 p.m. from the 2700 block of Warshun Road near FM428 and Green Valley Circle. She said numerous tow trucks had illegally entered the property of a business there and were taking several pickups.

Sheriff’s deputies responded and found four tow trucks from a Grayson County towing company lined up along the road ready to leave and a fifth tow truck loading a fifth pickup.

The deputy asked for the company’s legal documents. One of the drivers said the company had civil documents allowing them to remove the trucks. But the company had not obtained a court order, according to the sheriff’s report, voiding the civil documents.

One woman told the deputies that she saw the trucks entering the property and rode her horse over to stop them. She blocked the road on her horse, she said, and the drivers yelled and cursed at her.

Then they drove to another gate, broke off the lock and exited the property before being apprehended by the deputies.

Another woman said she owns the company, which is in Chapter 11 bankruptcy. She said a representative of the towing company came to the business earlier in the day, saying he had documents to remove “about 40” vehicles. She told him to get off her property, she said, and he left saying he would be back.

The owner said she parked a truck across the driveway to block the entrance where the men entered but they moved it to get onto her property. The deputy noted there were “no trespassing” signs on every gate.

Each of the six men was charged with five counts of burglary of a vehicle and criminal trespass. The deputies seized all five tow trucks, and on Monday they were still impounded.

Other reports

Denton County Jail — Former Dallas Cowboys player Eugene Lockhart Jr. was in and out of the jail within 45 minutes Saturday after being arrested by deputies on a release of surety warrant.

According to county records, Lockhart, 47, was arrested by Carrollton police Feb. 14 on a felony charge of possession of a controlled substance. He failed to report for a court hearing Sept. 15, court records show.

The hearing was rescheduled but Lockhart’s attorney asked to be removed from the case and his bail bonds company recalled the bond.

Since Lockhart no longer had a bond, Denton County issued a warrant for his arrest. After his arrest, another bonding company posted $3,500 bail for him, according to records.

The next hearing is set for Oct. 13.

Lockhart was a linebacker for the Cowboys from 1984 to 1990, when he was traded to the New England Patriots.

Eldorado Parkway at Garza Lane — Denton County recorded its first jumper from the new Lewisville Lake toll bridge Sunday, but deputies have not determined who should be accorded the dubious honor — or cited.

According to a sheriff’s report, witnesses reported seeing a man jump off the bridge about mid-afternoon.

Sheriff’s deputies and emergency workers responded and began searching, but found no one in the water.

Security video provided by the toll authority showed the man climbed out of a boat, ran across the bridge and jumped off. The boat then picked the man up and sped away, according to the report.

Sgt. Roger Griggs said there are signs prohibiting pedestrians on the bridge and the jump would have constituted criminal trespass.

300 block of West Sherman Drive — Denton police arrested a man and woman Sunday night after watching them walk out of a closed auto parts business with merchandise.

Officers responded to reports of numerous burglar alarms sounding at the business in all areas of the store, including the employee-only area.

The first officer on the scene about 9:15 p.m. saw the couple walk out the front door. At his inquiries, the couple explained that the man was working on the woman’s car and needed some parts.

They found the front door to the business open, so they went inside, they said.

The officer asked if they noticed that there were no clerks inside and that the sign on the door said the business closed at 8 p.m. The man said they did notice but planned to pay for the merchandise when police arrived.

He arrested them on burglary charges.
