Mayor’s ex still in jail on felony charges

Judge finds Cue’s bail insufficient on charges of document tampering

A Lake Cities woman, and former girlfriend of Lake Dallas Mayor Tony Marino, remained in Denton County Jail on Thursday after a judge ordered an additional $50,000 bail.

Nancy A. Cue, 49, had already posted $5,000 bail after a grand jury indicted her in May on felony charges of tampering with a government record. She was arrested again Dec. 21 after a Denton district judge found the previously posted bail, in connection with the tampering charges and three new felony indictments handed down in October, to be insufficient.

Stephen E. Reese, Cue’s attorney of record, could not be reached for comment Thursday.

Cue, whose aliases include Nancy Garcia and Nancy Kennedy, according to county court documents, began dating Marino several months before his first run for mayor in summer 2008. She regularly attended City Council meetings and other city functions with him.

Marino called the matter an unfortunate incident and said the relationship ended some time ago. He declined to comment further.

In September 2008, Lake Dallas police filed an arrest affidavit with Justice of the Peace Joe Holland, charging Cue with tampering with a government record. According to the arrest affidavit, Cue allegedly helped two minors convicted of alcohol possession falsify records for court-ordered community service in July 2008.

The case was transferred to district court in October 2008, and Cue was indicted on two felony counts of tampering with a government record the following month.

In May, Reese filed several motions with the court, and the judge dismissed the charges. The case was refiled that month, and another grand jury indicted Cue.

In October, a grand jury handed down three new felony charges. According to records filed with the three indictments, Cue allegedly forged a $5,000 check by using a check from the account of Michael and Isabel Marino and faking the signature of Isabel Marino. She also allegedly took Michael Marino’s name, address and bank numbers with the intent to use them fraudulently and allegedly altered her driver’s license to use it fraudulently, according to the indictment records.

Michael and Isabel Marino are Mayor Tony Marino’s parents.

According to enhancement paragraphs added to the indictments, Cue was convicted on aggravated robbery charges in Houston in 1979. If convicted of the current charges, Cue could face greater punishment than a state jail felony because of the previous felony conviction.
