Fight over Denton County liquor sales continues

The question of liquor sales in southeastern Denton County is far from settled.

A civil case challenging a May 2009 local option election over boundaries used in the county’s Justice of the Peace Precinct 2 took another turn today in district court.

Four months ago, state District Judge Jake Collier issued a ruling that essentially overturned the election to allow all alcohol sales in Precinct 2.

The precinct includes the cities of Little Elm, Oak Point, The Colony and Hebron and parts of Plano, Frisco and Lewisville.

Attorneys involved in the case are petitioning to have Collier disqualified because, as a judge in Denton County, he is elected by the same voters affected in this case. At issue is whether he should be disqualified, meaning all decisions in the case would be voided, or whether he is simply recused from further proceedings.

District Judge Don Cosby traveled from Tarrant County for today’s hearing in Denton. He is expected to rule on the motion to disqualify later this month.
