3 men indicted in heroin death

The grand jury indicted three men Thursday in the heroin intoxication death of a Justin woman on May 15.
Brian Oachs, 20, of Argyle, Tyler Rushing, 19, of Fort Worth and Timothy Taylor, 23, of Lewisville all are charged with delivery of a controlled substance causing death or serious bodily injury.
They remained in jail Friday in lieu of $100,000 bail on the charge.
Law enforcement officers said all three men are connected to another death that took place Sept. 21.
“You have a drug death take place in a man’s house and then he moves, and four months later another death takes place in his new house,” said Denton County Sheriff’s Narcotics Sgt. Jeff Davis. “The same group of people were at both parties, and we are waiting on toxicology reports on the second death but we believe it’s going to be drug-related.”
Oachs lived in the 1500 block of Seaborn Road in Ponder on May 15 when someone at the house called 911, saying they believed a woman was dead. Davis said officers and paramedics found Jaidi Barton, 19, unconscious and non-responsive on the floor.
Rushing was in severe medical distress with symptoms of a heroin overdose, the sergeant said. He was taken to a hospital and survived.
Toxicology reports showed that Barton died of acute heroin intoxication.
“A subsequent investigation determined that Timothy Taylor was the source of the heroin in both cases,” Davis said. “He was staying in a Lewisville hotel, and on May 16 we arrested him there and seized a quantity of heroin and paraphernalia used in the making of ‘cheese.’”
The drug is made from heroin and nighttime pain relievers and can be lethal, Davis said.
After an investigation, sheriff’s investigators charged Taylor, Oachs and Rushing with manslaughter.
Meanwhile, Oachs moved to the 400 block of Cactus Circle in Argyle. Parties involving many of the same circle of friends took place over the weekend of Sept. 19-21.
“We got another 911 call that Sunday morning,” Davis said. “We found Austin Durant dead in that house.”
Durant, 18, of Justin showed signs of a drug overdose before his death, witnesses told law enforcement officers. The cause of his death is awaiting toxicology reports.
“We expect to file more charges in this case after we find the result of those reports,” Davis said.
The sergeant said officers found heroin, marijuana and the prescription drug Xanax at the house, along with a keg of beer. James Benjamin Reynolds, 21, admitted to buying the beer with money provided by Oachs, he said. Reynolds was charged with providing alcohol to a minor.
Davis took the manslaughter charges to the grand jury. Members instead returned indictments for delivery of a controlled substance causing death or serious bodily injury, which is a third-degree felony punishable by two to 10 years in prison.
